Complaint: Kohl’s promised daily shipping minimums but fell short, costing Pandion $34 million
Package delivery company Pandion filed a $34 million lawsuit against Menomonee Falls-based retailer Kohl’s on Monday. According to the criminal complaint filed in Waukesha County, Pandion said Kohl’s agreed to use its services and provide a minimum number of packages each day for Pandion to deliver. Pandion was founded in 2020, when customers were looking to order more products online during the COVID-19 pandemic. Pandion said Kohl’s was one of its inaugural customers. At that time, Kohl’s agreed to provide a guaranteed minimum of packages, ranging from 4,500 to 27,000 per day, according to the complaint. Pandion then expanded its network and “incurred substantial costs.” Pandion also provided competitive shipping prices for Kohl’s to meet its obligations, according to the complaint. According to Pandion, Kohl’s fell more than five million packages short of its guaranteed minimums, amounting to more than $34 million in lost revenue for Pandion. The company then asked Kohl’s for compensation for the millions of packages agreed to but not provided. Pandion said Kohl’s would not compensate the company, “forcing Pandion to incur the costs of Kohl’s decreased shipping volume.” Kohl’s faced a shrinking online business and terminated its agreement with Pandion in November 2023, according to the complaint.
